WAIVER AND RELEASE OF LIABILITY

1. I hereby represent and certify that I am at least 18 years of age and I understand that participation the Walker Tracker Program is purely voluntary on my part and that Walker Tracker is not owned or operated by Greater Huntington Walks or any of its affiliates or sponsors. I further acknowledge that participation in the Walker Tracker Program involves physically demanding activities, and that there are risks of physical injury, harm or death from participating in activities through the Walker Tracker Program.

2. I hereby acknowledge and agree to assume the entire risks of any accidents or personal injury, including death, I might suffer as a result of my participation in the Walker Tracker Program.

3. I, for myself, and for my spouse, legal representatives, heirs and assigns, hereby release, waive, discharge and hold harmless Walker Tracker, Greater Huntington Walks, and its affiliated entities, and its shareholders, directors, officers, employees, agents and other representatives (collectively, the “Greater Huntington Walks Entities”), from all liability to me, and/or to my spouse, legal representatives, heirs and assigns, for any and all loss or damage, and any claim or damages, resulting from participation in the Walker Tracker Program on account of injury to my person or property, even injury resulting in my death, whether caused by the negligence of the Greater Huntington Walks Entities or otherwise, while I am engaging in participation in the Walker Tracker Program.

4. I hereby acknowledge that: (a) my participation in the Walker Tracker Program is completely voluntary on my part, (b) none of the Greater Huntington Walks Entities have expressly or impliedly required me to participate in the Walker Tracker Program , (c) participation in the Walker Tracker Program is neither part of my job duties for the Greater Huntington Walks Entities nor a regular incident of my employment, and (d) none of the Greater Huntington Walks Entities derive a substantial benefit from my participation in the Walker Tracker Program beyond the intangible value of improvement in employee health and morale common to all kinds of recreation and social life. Given the above, I understand that should I be injured while participating in the Walker Tracker Program, said injury will not be compensable under the Greater Huntington Walks Entities’ workers’ compensation insurance.

I, the undersigned, declare that I have read, understood and voluntarily executed this final and complete Waiver and Release of Liability without any inducement, assurance, guarantee or representation being made to me other than the foregoing written agreement.

Greater Huntington Walks was to created to help shine a positive light on our area by building a healthier tomorrow for your family, your kids, and of course, you. It aims to create an active culture within out community and show the world that central Appalachia is an active and engaged area that values health and wellness.

The Greater Huntington Area has already made the 478,000,000 step journey to the moon, now help us get back! Register today to be part of the movement!

If you don't have access to an electronic pedometer device, pedometer's are available at the following locations:

• Huntington’s Kitchen
• St. Mary's Medical Center and Cabell Huntington Hospital information desks
• Marie Redd Center
• AD Lewis
• Huntington YMCA
• Marshall Rec Center

PLEASE NOTE: Pedometers are on a first come, first serve basis.
